1. Scope of Services
These Terms and Conditions (“Terms”) govern all services Empowered Media Australia Pty Ltd provides. By engaging with our services, you agree to these Terms. Our services include, but are not limited to, the production of print and online publications, custom content creation, and advertising solutions.

2. Agreement to Terms
By accessing our services, clients acknowledge that they have read, understood, and agreed to be bound by these Terms.

3. Service Provision and Content
Empowered Media Australia commits to providing professional and quality content for print and digital publications, which may include magazines, directories, calendars, and other custom formats. All content is produced according to the client’s specifications; however, we retain the right to make editorial changes to ensure alignment with professional standards.

Customer Obligations

Customers are responsible for:

  • Providing accurate, timely, and lawful content for adverts.
  • Ensuring that all material submitted complies with intellectual property laws.
  • Promptly reviewing content drafts if proof is requested. Proofs are available upon customer request, and any final approvals or modifications based on the evidence must be communicated within the stipulated review period.
  • Paying for the advertisement as specified in the service agreement. All advertising services fees are due per the payment terms outlined in the invoice or contract, regardless of any content or proof approval process.
  • Submitting artwork for the advertisement. If no artwork is submitted, Empowered Media Australia will create an advertisement based on the basic details provided in the booking order.

5. Content Approval, Modifications, and Timeframe
Any changes requested by the customer post-approval may incur additional charges. Empowered Media Australia reserves the right to refuse modifications that conflict with ethical standards or legal guidelines. Customers must review and approve content within the specified timeframe Empowered Media Australia provides. Failure to respond within this timeframe may result in automatic approval of the content as initially provided.

6. Payment Terms
Clients agree to pay all fees specified in the service agreement. Payment is due upon invoice receipt unless otherwise agreed. Late payments may incur interest charges and administrative costs.

7. Taxes and Additional Costs
Unless specified otherwise, all fees exclude applicable taxes. Clients are responsible for all taxes, duties, or fees that may be associated with the services provided.

8. Cancellations and Refunds
Cancellations may incur fees based on the work completed up to the cancellation date. The customer is responsible for covering any costs already incurred, which may include. Once the customer approves an advertising order in writing, they have seven days to request changes without incurring total fees. After these seven days, the customer may be liable for up to the project’s total cost.

9. Liability and Indemnification
Empowered Media Australia Pty Ltd shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Clients agree to indemnify and hold Empowered Media Australia harmless against any claims, damages, or expenses arising from content provided by the client.

10. Intellectual Property Rights
All intellectual property rights related to custom publications and other content created by Empowered Media Australia remain the property of Empowered Media Australia unless otherwise agreed in writing.

11. Amendments to Terms
Empowered Media Australia reserves the right to modify these Terms at any time.
